Terms of Service
The short version
- Kodi helps you manage your rental properties: houses, tenants, rent, bills, payments and messages.
- Your records belong to you. We look after them and never sell them.
- Every new account starts with a free 3-month trial. Before it ends we agree a plan with you.
- SMS is paid for with prepaid credits at KES 2 per message. Credits are not refundable.
- You are responsible for what you enter and for the messages you send to your tenants.
1. Who we are
1.1Kodi is property management software for landlords and property managers in Kenya. In these terms, "Kodi", "we", "us" and "our" mean Kodi, the provider of the Kodi service. You can reach us by email at support@kodirentals.com.
2. Words we use
2.1"You" and "Landlord" mean the person or business that creates a Kodi account to manage properties, and anyone they allow to use that account.
2.2"Tenant" means a person whose details a Landlord enters into Kodi, including when they use the tenant portal.
2.3"Service" means the Kodi app, the tenant portal, the website and the SMS and payment features that come with them.
3. Accepting these terms
3.1By creating an account or using Kodi you accept these terms. If you use Kodi for a business, you confirm you are allowed to accept them for that business.
4. The service
4.1Kodi lets you record properties, houses, tenants and tenancies; bill rent, water, electricity and other charges; record payments and issue receipts; send SMS to tenants; give tenants a portal to see their balance; store tenant documents; and produce reports.
4.2Kodi is a record-keeping tool. It does not hold, collect or move your money: rent paid by tenants goes directly to you, through M-Pesa, your bank or in cash.
5. Your account
5.1You sign up with your phone number and a password. The information you give us must be true and up to date.
5.2Keep your password private. You are responsible for everything done through your account. Tell us straight away if you think someone else has used it.
5.3You decide which tenants get a portal login and you can reset or remove their access at any time.
6. Free trial
6.1Every new account gets a free 3-month trial with the full service. No card or payment is needed to start.
6.2Before the trial ends we will get in touch to agree a plan that suits the number of houses you manage. If you choose not to continue, clause 9 applies.
7. Your plan
7.1After the trial, the service continues on the plan and price we agree with you in writing (an invoice, a message or an email from us counts).
7.2Plan fees are paid in advance for the period agreed. Prices may change for future periods; we will tell you at least 30 days before a change affects you.
7.3Plan fees already paid are not refundable, except where these terms say otherwise or the law requires it.
8. SMS credits and messages
8.1Messages sent through Kodi use prepaid SMS credits. At the time of writing one SMS of up to 160 characters to one phone number costs KES 2; a longer message uses more than one credit. Kodi shows the number of messages and the cost before you send.
8.2You buy credits by topping up your SMS wallet. Credits are added once we confirm your payment. SMS credits are not refundable and cannot be exchanged for cash.
8.3Messages are delivered through a licensed SMS provider and the mobile networks. We cannot promise every message reaches every phone (for example if a number is wrong or a phone is off). Kodi records which messages were sent and which failed, and lets you resend failed ones.
8.4You are responsible for what you send. Messages must be about your tenancies — rent, bills, receipts, notices and similar. Do not use Kodi to send advertising, political messages or messages to people who have asked you not to contact them.
9. Paused accounts
9.1If the trial ends without a plan, or a plan fee is still unpaid 14 days after it was due, we may pause your account. We will remind you before we do.
9.2While an account is paused you cannot add or change records, and tenant portal access stops. Your records are kept safe.
9.3We keep a paused account’s records for at least 90 days. Paying the amount due during that time restores everything as it was. After 90 days we may delete the account and its records, after telling you first.
10. Your data and your tenants’ data
10.1The records you enter — including your tenants’ details — belong to you. We use them only to provide the service, as explained in our Privacy Policy, and we never sell them.
10.2For your tenants’ personal data, you are the data controller and Kodi processes it on your behalf, under the Data Protection Act, 2019. You confirm you have a lawful reason to keep each tenant’s details and to send them messages, and that you will tell tenants you use Kodi to manage their tenancy.
10.3You can print or download receipts, statements and reports at any time. If you close your account, ask us and we will help you take a copy of your records first.
11. Your responsibilities
11.1You are responsible for the accuracy of what you enter — rents, readings, charges, payments and phone numbers — and for correcting mistakes. Kodi keeps corrections on the record so your books stay traceable.
11.2You are responsible for complying with the laws that apply to you as a landlord, including tax. Kodi’s rental income tax figure is an estimate to help you plan; confirm your filings with KRA or a tax adviser.
12. Acceptable use
12.1Do not misuse Kodi: do not try to reach another landlord’s records, break or overload the service, copy or resell it, upload harmful files, or use it for anything unlawful.
13. Payments, balances and receipts
13.1Balances, receipts and statements in Kodi are worked out from the charges and payments recorded in your account. They are only as accurate as those records.
13.2A payment a tenant submits through the tenant portal is not added to their balance until you confirm it.
14. Bank and M-Pesa connections
14.1Where you connect a bank account so payments can be matched automatically, you authorise your bank to send Kodi notifications of payments into that account, and Kodi to use them to post rent payments to your tenants.
14.2Only payments that carry one of your house numbers are posted. Payments Kodi cannot match are left for you to review. Kodi cannot see or move money in your account.
14.3The connection depends on your bank’s and the mobile network’s systems. If they are unavailable, payments may be delayed or need to be recorded by hand.
15. Support
15.1Email support@kodirentals.com. We aim to reply on working days, and sooner for problems that stop you from working.
15.2If you ask for help with your account, our staff may need to look at your records to fix the problem. They only do so for that purpose.
16. Changes to the service
16.1We improve Kodi regularly and may add, change or remove features. We will not remove a main feature you rely on without telling you first.
16.2We work to keep Kodi available at all times, but there may be short interruptions for maintenance or outside our control.
17. Closing your account
17.1You can close your account at any time — see Delete your account. Records are deleted as described there.
18. Suspension by us
18.1We may suspend or close an account that seriously breaks these terms, for example by misusing SMS or trying to access other landlords’ records. Where we can, we will warn you first and give you a chance to put things right.
19. Disclaimers
19.1Kodi is provided "as is". We do our best to keep it accurate, secure and available, but we do not promise it will be free of errors or interruptions.
20. Limitation of liability
20.1We are not liable for indirect losses, such as lost rent or lost profit, or for losses caused by inaccurate information you entered.
20.2Our total liability to you is limited to the plan fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow us to limit.
21. Changes to these terms
21.1We may update these terms. If a change materially affects you, we will tell you at least 30 days before it takes effect, inside Kodi, by SMS or by email. If you keep using Kodi after that, you accept the updated terms.
22. Disputes and governing law
22.1These terms are governed by the laws of Kenya.
22.2If a dispute arises, please contact us first; both sides will try in good faith to settle it within 30 days. If that fails, either side may refer it to mediation in Nairobi, and after that to the courts of Kenya.
